Civil Matters We Handle

Looking for a Texas civil litigation attorney who will advocate with confidence? The Omar Ochoa Law Firm has experience representing individuals, small businesses, and large corporations in civil litigation cases:

Business Litigation

Our skilled legal team handles commercial litigation and business disputes involving both large and small companies. Our attorneys know business law and can help you obtain the most favorable outcome.

Contract Disputes

A litigation attorney can help protect client interests and settle matters in contract disputes, which are often resolved through negotiation, mediation, or arbitration. Our firm represents individuals, employees, and contractors, as well as employers and businesses, in contract disputes.

Partnership & Shareholder Disputes

Disagreements between partners, shareholders, and others can be very stressful and impact business. A dispute may require a lawyer or lawsuit to resolve matters, avoid a bankruptcy filing, or other issues.

Non-Compete/Non-Disclosure Disputes

If you signed a non-compete or non-disclosure agreement and then violated it, you may be sued for that breach. It is always advisable to speak with a lawyer because not all of these contracts are enforceable.

Whistleblower Litigation

Under Occupational Safety and Health Administration (OSHA) regulations, employees are protected from retaliation when raising or reporting concerns regarding workplace safety and health. You might be entitled to damages if you were fired after reporting a safety issue.

Eminent Domain

Eminent domain involves the government's power to take private property from one party for public use. It often occurs in Texas when roadways or pipelines are expanded. Our civil litigation attorneys can advise you of your rights regarding eminent domain.

Class Action Litigation

Class action lawsuits often involve defective products and dangerous drugs. Examples of notorious class action suits are the 1998 Tobacco Master Settlement Agreement, the Deepwater Horizon oil explosion, and the Volkswagen Diesel emissions scandal.

Construction Defect Litigation

Construction defects are common, and Texas has a specific law, the Texas Residential Construction Liability Act (RCLA), which establishes notice and filing procedures. Our attorneys know how to fight for justice for construction defect victims.

Oil & Gas Litigation

The Omar Ochoa Law Firm handles plaintiff client disputes with oil and gas companies, including royalty interests disputes; joint operating agreements; shale and fracturing disputes; pipeline, transportation, and storage disputes; and fraud claims.

If damage to your property occurred due to pollution from an oil and gas company, a civil litigation attorney can help you pursue damages. Monetary compensation may vary depending on the damage involved.

How Does the Texas Civil Litigation Process Work?

Civil litigation cases vary widely in their individual circumstances, but all plaintiffs must follow some specific procedures while navigating the justice system. Civil litigation in Texas has a few basic phases:

Opening Investigation

During the opening investigation phase, attorneys review the claim to determine whether there is enough evidence to support a case.

Pleadings Phase

During the pleadings phase, legal documents, including the complaint and answer, are filed.

Discovery Phase

In discovery, legal representatives for each side begin deeper investigations and review the evidence presented by the opposing counsel.

The pre-trial phase starts with research into whether you have a claim that a judge would hear, including verifying that you are in the right jurisdiction. After filing a complaint, you must notify the other party and allow them to respond.
Discovery is also part of the pre-trial phase. It is the process of obtaining relevant information from the other party. A case may be settled out of court at any time before trial, and courts encourage parties to consider and investigate alternative dispute resolution.

If a case goes to trial, jury selection will be made first (if it is not waived). A judge or jury will listen to both sides and then make a decision about the case. While you are allowed to represent yourself, it is not advisable to represent yourself in court without a lawyer if you are not well-versed in civil court procedure.
Without a civil litigation lawyer, you will frustrate the judge and be extremely vulnerable to procedural errors and mistakes that can cost you a lot of money and time in the long run.

After the trial, you may have options to respond to an order (including modifications and appeals), but you only have a limited time and must act quickly.
Motions may be filed on either side (plaintiff or defendant) during the pre-trial phase or the trial. These include requests for jury, motions to amend, motions for continuance, and temporary orders (like not to sell a business during litigation).
Due to the complex nature of civil lawsuits, it is always advisable to have a lawyer represent you through the process.

FAQs About Civil Litigation in Texas

Do I need a civil litigation attorney in Texas?

If you don’t have legal experience and understand relevant laws and required procedures, you risk possibly having your case dismissed. In the long run, this can cost you more when you have to hire a civil litigation attorney later.

Protect yourself by hiring a civil litigation lawyer who understands the Texas court system and will advocate for your rights.

What is a civil lawsuit?

A civil lawsuit is one that involves an attempt to collect money damages and does not involve criminal charges. In some cases, a civil litigation case follows a separate criminal matter related to the same event, such as a civil wrongful death case following a criminal murder trial.

A civil litigation case usually involves a person, business, agency, or other organization suing another for money. They may also file a suit regarding property. Celebrities suing tabloids, hurt consumers suing drug manufacturers, personal injury claims after car accidents, and contract disputes that end up in court are all examples of civil cases.

A divorce is also a type of civil case, although, from a practice areas standpoint, divorce matters are usually handled by family law and divorce attorneys, not civil litigation lawyers.

What is the difference between settlement and trial?

A settlement is a resolution of a lawsuit outside of (before) going to court. A trial is a formal examination of evidence and a decision by a judge or jury about a legal matter. With civil litigation, settlements can be reached at any stage before trial. If a settlement cannot be reached, a trial may be necessary.
