What is Product Liability?

Product liability refers to a manufacturer or retail seller placing a defective product in the market. This product, in some way, results in harm, typically injury or death, to a consumer. The manufacturers and sellers of these dangerous products are generally responsible. In some cases, even companies that supply parts may be liable for injuries caused by those parts.

Types of Product Liability Claims

While product liability claims can vary greatly, they all generally fall into one of three categories. These categories are manufacturing defect, design defect, or marketing defect. Manufacturing defects are what usually comes to mind when thinking of a product liability claim. A defectively made product is dangerous due to an error in some way it was manufactured.

A design defect on the other hand is when a product is manufactured correctly but is dangerous in someway by the nature of the design such as a lamp that catches fire when left on for an extended period of time. Last, a marketing defect occurs when a product is marketed incorrectly, or a company fails to put adequate warnings on their product.
